Avantgarde Distribution Limited

The contract between us :
In this contract, “We” “Us” and “Our” all denote references to Avant Garde Distribution Limited and references to “You” “Your” are references to You as the consumer entering into a contract with Avant Garde Distribution Limited on these terms and conditions .We must receive payment of the whole of the price for the goods that You order before Your order can be accepted. Once payment has been received by Us, We will confirm that Your order has been accepted by sending an email to You at the email address You provide in Your order form. Our acceptance of Your order brings into existence a legally binding contract between Us and You.


Price:
The prices payable for goods that You order are as set out in our website from time to time at the point in time that you submit Your order.
You will be required to pay extra for delivery and it might not be possible for Us to deliver to some locations. Our delivery charges and terms are set out in Our website. Please refer to the same before placing Your order since they form part of the contract made between Us and You.


Right for You to cancel the contract:
Subject to Clause 3.2 below, You may cancel Your contract with Us for the goods You order at any time up to the end of the seventh working day from the date You receive the ordered goods. You do not need to give Us any reason for cancelling Your contract nor will You have to pay any penalty.
3.2 You cannot cancel the contract if the goods have been used and are within the general classification of personal items such as earphones, cosmetics, health and beauty or personal appliances and accessories or other products where the goods could be subject to contamination or if you have taken any telecommunications, audio or video recording equipment or computer hardware or software out of the sealed package in which it was delivered to You. Please refer to our Returns policy for full details before placing Your order.
To cancel the contract You must notify us in writing which includes by way of email notification to the following email address: [ ].
If You have received the goods before You cancel the contract then unless, under Clause 3.2, You do not have a right to cancel You must send the goods back to Our contact address at Your own cost and risk. If You cancel the contract but We have already processed the goods for delivery You must not unpack the goods when they are received by You and You must send the goods back to Us at Our contact address at your own cost and risk as soon as possible.
Once You have notified us that You are cancelling the contract, any sum debited to Us from Your credit card will be re-credited to Your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by You and received by Us in the condition they were in when delivered to You. If You do not return the goods delivered to You or do not pay the costs of delivery, We shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to You.

Cancellation by Us:
We reserve the right to cancel the contract between Us and You if:
We have insufficient stock to deliver the goods You have ordered;
We do not deliver to your area; or
one or more of the goods You ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by Us from Our suppliers. While We try and ensure that all prices on Our website are accurate, errors may occur. If We discover an error in the price of goods You have ordered We will inform You as soon as possible and give You the option of reconfirming Your order at the correct price or cancelling it. If We are unable to contact You We will treat the order as cancelled. If You cancel and You have already paid for the goods, You will receive a full refund.

If We do cancel Your contract, We will notify You by e-mail and will re-credit to Your account any sum deducted by Us from Your credit card as soon as possible but in any event within 30 days of Your order. We will not be obliged to offer any additional compensation for disappointment suffered.

Delivery of goods to You:
We will deliver the goods ordered by You to the address You give us for delivery at the time You make Your order.
Delivery will be made as soon as possible after Your order is accepted and in any event we will use all reasonable endeavours to deliver within 30 days of Your order. We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable due to unforeseen factors.

You will become the owner of the goods You have ordered when they have been delivered to You unless either You or We cancel the contract in accordance with the terms herein. Once goods have been delivered to You they will be held at Your own risk and We will not be liable for their loss, damage or destruction.

Liability:
If the goods We deliver are not what You ordered or are damaged or defective or the delivery is of an incorrect quantity, We shall have no liability to You unless You notify us in writing at Our contact address of the problem within 10 working days of the delivery of the goods in question.
If You do not receive goods ordered by You within 30 days of the date on which You ordered them, We shall have no liability to You unless you notify us in writing at Our contact address of the problem within 40 days of the date on which You ordered the goods.
If You notify a problem to Us under this condition, Our only obligation will be, at Our option:
to make good any shortage or non-delivery;
to replace or repair any goods that are damaged or defective; or
to refund to You the amount paid by You for the goods in question in whatever way we choose.
Save as precluded by law, We will not be liable to You for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem You notify to Us under this condition and We shall have no liability to pay any money to You by way of compensation other than to refund to You the amount paid by You for the goods in question under clause 6.2.3 above.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from Our website. The importation or exportation of certain of Our goods to You may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods You purchase.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights You might have as a Consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit Our liability to You for any death or personal injury resulting from Our negligence. We have selected our product lines on the basis that they will be used for domestic use only. If You use them for business purposes please make sure that You are covered by the appropriate insurance. Where You decide to use the goods in the course of a business, We exclude (to the fullest extend permitted by law) those warranties, terms and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in connection with the contract shall be limited to the replacement value of the goods in question (except in the case of death or personal injury caused by Our negligence or in respect of fraud). In relation to business users, We do not accept liability for the fitness of goods for business purposes, nor do We accept liability for loss of use of the item nor any loss over and above the cost of the item in the event of a claim for breach of warranty or condition.


Notices:

Unless otherwise expressly stated in these terms and conditions, all notices from You to Us must be in writing and sent to Our contact address at (insert postal address) and all notices from Us to you and other users of our website will be displayed on Our website from to time. Events beyond our control:
We shall have no liability to You for any failure to deliver goods You have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond Our reasonable control including, without limitation, shortage of or delays in receiving supplies of goods into our warehouse or storage facility due to act or omission of our suppliers, strikes, fuel shortages, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion, accident or Act of God.


Invalidity:
If any part of these terms and conditions is unenforceable (including any provision in which We exclude or limit our liability to You) the enforceability of any other part of these conditionswill not be affected.


Privacy:
You acknowledge and agree to be bound by the terms of Our privacy policy. Please refer to our privacy policy appearing on our website.

Third party rights:
Except for Our affiliates, directors, employees or representatives, a person who is not a party to the contract formed between Us and You has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of the contract but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
Governing law
The contract between Us and You shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.


Entire agreement:
These terms and conditions, together with Our current website prices, delivery terms, contact details and privacy policy, set out the whole of the terms of the contract relating to the supply of the goods to You by Us. Nothing said by any sales person on Our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by Us. Save for fraud or fraudulent misrepresentation, We shall have no liability for any such representation being untrue or misleading. All sizes and measurements are approximate but we do try to make sure that they are as accurate as possible. We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website and it is Your responsibility to read the terms and conditions on each occasion You use this website and Your continued use of the website shall signify Your acceptance to be bound by the latest terms and conditions.

Returns:
We hope that you will be very pleased with your purchases from mytrampolines.co.uk. However, we understand that there may be occasions when you will need to return items to us. To return a product please read the following carefully. This Returns policy is also subject where applicable to our terms and conditions of sale as appears on our website. Please read those before proceeding with your purchase. In the event of any conflict or inconsistency with this Returns policy, our terms and conditions of sale take precedence.
In addition to your statutory rights, if you wish to return goods outside of the 7 day cancellation period, we operate a 28 day faulty returns policy.
Any goods which are defective at the point of delivery and notified to us within 28 days will be replaced as will goods that are not apparently defective at delivery but which develop a fault during the 28 day period provided that they have been used properly in accordance with instructions for the purpose intended for those goods.
Refunds will be to the value of the goods only and will not include any carriage costs paid to us which is your responsibility.
Please ensure that all returns are securely wrapped and packaged. We cannot be held responsible for any goods that have been damaged in transit.
We would recommend using a posting method that provides a proof of delivery and can compensate for lost or damaged goods for higher value items (please consult your chosen courier prior to shipping for details).
We do not operate a try before you buy policy.
Goods found to be tampered with or attempted to be repaired by the customer or by someone on their behalf will not be replaced, but will be returned at the customer's expense.
If you wish to return goods which are not faulty, we will accept the return providing the goods are in a good clean condition, in the original packaging and having not been used. These goods can be exchanged for other products, subject to the difference in costs being incurred. Items returned for a refund, when the goods are not faulty will be charged a handling fee of 15%.
Used earpieces and Bluetooth headsets, cosmetics, health and beauty or personal appliances and accessories or other products where the goods could be subject to contamination and other products stipulated in our Returns policy from time to time will not be accepted due to hygiene reasons.
Software disks, games, UMD disks, films and creams cannot be returned if the security seal has been broken.
In certain circumstances, faults will need to be diagnosed by the manufacturers of the item before a replacement can be issued (i.e. memory card reading faults, handset not powering up etc.).
Replacement or alternative items will be processed as promptly as possible, but please be aware that it may take up to 5 working days to issue the item. If an item is out of stock, it will then become a priority back order to be shipped once stock is available.
Refunds by credit card are made to the same credit card that was used for the original transaction. Please be aware that it may take up to 14 days for your card to be refunded. The above conditions are in addition to your statutory rights, which are not affected.
Refunds to UK customers for cheque payments, bank transfers and bank deposits are made via return cheque.
